1. Purpose

This Acceptable Use Policy (the “Policy”) sets forth the rules and restrictions governing your use of Keni’s Services and Technology, including all voice, messaging, automation, and CRM tools provided by GETKENI LLC (“Keni,” “we,” “us,” or “our”).

This Policy is incorporated by reference into Keni’s Terms of Service and applies to all users, customers, and their authorized personnel.
By using our Services, you agree to the most recent version of this Policy.


2. General Use Requirements

All communications and activities conducted through Keni’s Services must comply with applicable laws and industry standards, including those governing privacy, consent, and communications.

You are responsible for ensuring that your use of Keni does not result in the transmission of unwanted, illegal, or harmful content.
Keni reserves the right to suspend or terminate accounts that violate this Policy.


3. Consent Requirements

3.1 Standard Consent

Before sending any message to an individual, you must obtain explicit consent (opt-in) from the recipient.
You must:

Clearly disclose that the person is agreeing to receive messages of the type you intend to send.

Maintain a record of such consent (e.g., timestamp, digital form, or written authorization).

Reconfirm consent if a significant amount of time has passed since it was obtained.

Avoid using purchased or third-party contact lists.

3.2 Alternative Consent Scenarios

a. Contact initiated by the individual:
If a person messages your business (e.g., asking for store hours), you may respond to that inquiry.
However, consent is limited to that conversation unless you obtain additional authorization.

b. Prior business relationship:
You may send informational messages (e.g., appointment reminders, receipts, confirmations) to individuals who have provided their contact information and have not opted out.
These messages may not include marketing, promotions, or advertising content without explicit consent.

3.3 Ongoing Messages and Opt-Out

If you plan to send recurring messages, you must:

Include clear opt-out instructions in the first message (e.g., “Reply STOP to unsubscribe”).

Honor all opt-out requests immediately.

Reconfirm ongoing consent periodically according to industry best practices.


4. Identification Requirements

Each message sent through Keni must clearly identify your business or brand as the sender.
Follow-up messages in an existing conversation may omit identification if contextually clear.


5. Prohibited Content

You agree not to use Keni’s Services to create, send, or promote any content that is illegal, misleading, or harmful, including:

5.1 Unsolicited Messages (“Spam”)

Unsolicited promotions, advertisements, or informational messages sent without proper consent.

5.2 Illegal or Fraudulent Activities

Including but not limited to:

Fraudulent offers, scams, or pyramid schemes.

High-risk financial products (e.g., payday loans, crypto schemes).

Sale or promotion of illegal substances, firearms, or regulated products.

“SHAFT” content (Sex, Hate, Alcohol, Firearms, Tobacco, or vaping).

5.3 Infringing or Offensive Material

Content that is harassing, defamatory, obscene, threatening, or violates intellectual property rights.

5.4 Harmful or Malicious Content

Any content that contains viruses, trojans, worms, or code designed to disrupt systems.

5.5 Evasion or Deceptive Practices

You may not attempt to bypass Keni’s or carrier spam filters through:

Intentional misspellings or code obfuscation.

“Snowshoeing” (spreading identical messages across multiple numbers).

Shared public URL shorteners (e.g., Bitly, TinyURL). Use custom domains instead.


6. Reverse Engineering and Misuse

You may not:

Modify, copy, or create derivative works of Keni’s software.

Reverse engineer, decompile, or extract Keni’s source code or algorithms.

Circumvent security measures or rate limits.

Remove or obscure proprietary notices.


7. Reasonable Use and Service Limits

All Services, including automations, bulk messaging, and API integrations, are subject to fair usage limits based on your subscription plan.
Excessive or abnormal use that affects platform stability may result in suspension or termination.


8. Monitoring and Enforcement

Keni reserves the right (but not the obligation) to:

Monitor communications and content transmitted via its Services.

Investigate violations of this Policy or the Terms of Service.

Remove, disable, or restrict access to accounts or content that violates these rules.

Report illegal activity to law enforcement or regulators.


9. Reporting Violations

If you become aware of any misuse of Keni’s Services or a violation of this Policy, please report it immediately to:

10. Modifications

GETKENI LLC may update or modify this Policy at any time.
